Choice of Law

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, USA and relevant Federal laws without giving effect to any principles or conflicts of law. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. Any litigation arising under this Agreement shall be brought in the Commonwealth of Virginia. The parties agree to first try to resolve any dispute or controversy arising out of, in connection with, or relating to this Agreement between them. If they are unable to do so, the parties then agree to seek mediation before a mediator acceptable to each of the parties. Said mediation shall take place in the Commonwealth of Virginia, Fairfax County.

Termination and Restriction of Use

Evaluweb may terminate this Agreement and terminate or suspend your access to the Evaluweb Web Sites at any time, with or without cause, with or without notice. Upon such termination or suspension, your right to use Evaluweb will immediately cease. UPON SUCH TERMINATION OR SUSPENSION, ANY INFORMATION YOU HAVE STORED ON THE SITE MAY NOT BE RETRIEVED LATER.
